Terms of Service

1. Eligibility and Accounts

You must be old enough to consent to these Terms in your jurisdiction (at least 13, or higher where required). You are responsible for your account credentials and all activity under your account. You must provide accurate registration information and keep it up to date. You may sign in with email, phone verification, Sign in with Apple, Google, or other methods we support.

Notify us promptly at support@iamkateai.com if you suspect unauthorized access to your account.

2. The Services

kate offers optional features that may include travel planning, AI personas and chat, messaging, an in-app browser, music, language learning, diet and nutrition tools, personal finance tracking, online stores, health and wellness estimates, news, games, and other tools. We may add, change, or remove features at any time. Some features require device permissions or a network connection.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, fraudulent, or abusive purposes;
• Upload content that infringes others' rights or violates applicable law;
• Attempt to gain unauthorized access to accounts, systems, or data;
• Interfere with or disrupt the Services or other users;
• Reverse engineer or scrape the Services except where permitted by law;
• Use automated means to access the Services without our permission;
• Misrepresent AI-generated output as human professional advice (medical, legal, financial, or otherwise).

We may investigate violations and suspend or terminate accounts, remove content, or report activity to authorities where appropriate.

4. Your Content

You retain ownership of content you submit. You grant us a worldwide, non-exclusive license to host, store, reproduce, display, and process your content solely to operate, provide, and improve the Services (including AI features you invoke and published storefronts or sites you choose to make public).

You represent that you have the rights to submit your content and that it does not violate these Terms or third-party rights. We are not obligated to monitor all content but may remove content that violates these Terms.

5. AI Features

AI-generated text, images, audio, or suggestions may be inaccurate or incomplete. They are provided for general information and convenience only. You are responsible for how you use AI output. Do not rely on kate for medical diagnosis, legal advice, or investment decisions. See our Privacy Policy for how AI-related data is processed.

6. Online Store and Payments

If you operate an online store through kate, you are responsible for your products, pricing, taxes, shipping, refunds, and compliance with consumer and payment laws. Merchants connect their own Stripe account to accept payments; Stripe's terms apply to those transactions. kate is not the seller of merchant goods unless we clearly state otherwise.

On iOS, digital features or subscriptions for the kate app itself (if offered) must use Apple In-App Purchase where required by Apple's guidelines. Merchants must not use external checkout for digital goods or services that Apple requires to be sold through IAP.

7. Health and Wellness

Wellness features (such as camera-based heart-rate-style estimates) are not medical devices and are not a substitute for professional healthcare. Use them at your own discretion.

8. Intellectual Property

The Services, including kate branding, software, and design, are owned by us or our licensors and protected by intellectual property laws. Except for the limited rights to use the Services under these Terms, no license is granted to you.

9. Third-Party Services

The Services may link to or integrate third-party services (maps, sign-in, payments, AI, and others). Those services are governed by their own terms and policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100), EXCEPT WHERE SUCH LIMITS ARE NOT PERMITTED BY LAW.

12. Termination

You may stop using the Services at any time and delete your account from the app (Profile → Delete Account) or as described on our Account Deletion page. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive.

13. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated in the app or by email. Continued use after changes take effect constitutes acceptance, unless applicable law requires otherwise.
